My Three Keys App
Welcome to My Three Keys. These Terms and Conditions (“Terms”) govern your access to and use of the My Three Keys mobile safety application available on the Apple App Store and Google Play Store (the “App”).
Please read these Terms carefully before using the App. By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Safety & Emergency Disclaimer (CRITICAL)
Not a Replacement for Emergency Services: My Three Keys is a supplemental safety and location-sharing tool. It is not a replacement for local emergency services (such as 911). In any immediate danger or life-threatening situation, always contact official emergency authorities first.
No Guarantee of Delivery or Accuracy: The App relies on internet connectivity, satellite GPS signals, third-party cellular networks, and external service infrastructure partners. We do not guarantee that your location data will always be accurate, up-to-date, or available. Delivery of emergency SMS notifications or alerts is fundamentally dependent on external cellular networks and cannot be guaranteed to occur instantly, or at all. Furthermore, delivery may fail completely due to factors outside our control, including but not limited to: recipient device power status, lack of cellular service, operating system network restrictions, user-disabled location permissions, or cellular carrier network spam filters blocking outbound automated messages.
Assumption of Risk: You use the App at your sole risk. We are not liable for any bodily harm, death, property damage, or loss resulting from the use, failure, or delay of the App's tracking or notification systems. The App is used for notification purposes only.
2. Eligibility & Account Security
Age Limit
You must be at least 13 years old to use the App.
Account Responsibility
You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify My Three Keys at support@mythreekeys.com immediately upon learning of any unauthorized access.
Contact Accuracy
You must provide accurate contact information for yourself and your designated emergency/trusted contacts. By entering such contact information, you warrant that you have obtained permission from your contacts to share their contact information with the App.
3. Subscriptions & In-App Purchases
Premium Features
Certain features of the App may require a paid subscription or one-time in-app purchase.
Billing and Payments
All transactions, purchases, and subscriptions are processed and managed securely through the Apple App Store or Google Play Store. You agree to pay all fees incurred through your app store account at the rates in effect when charges are incurred.
Automatic Renewal
Paid subscriptions automatically renew at the end of each billing cycle (e.g., monthly or annually) unless you cancel your subscription at least 24 hours before the renewal date.
Cancellations & Refunds
You can cancel your subscription at any time through your Apple ID or Google Play account settings. All refunds are subject to the respective policies of Apple or Google, and My Three Keys does not issue refunds directly.
4. Acceptable Use & License
Limited License
My Three Keys grants you a personal, non-exclusive, non-transferable, revocable license to use the App on compatible mobile devices for your personal, non-commercial safety use.
Prohibited Conduct
You agree not to use the App to stalk, harass, track, or spy on anyone without their explicit consent. You agree not to reverse engineer, decompile, or attempt to extract the source code of the App, or use the App for any illegal or fraudulent purposes.
5. Intellectual Property
All content, features, branding, logos, design, and source code of the App are the exclusive property of Breadcrumbs LLC. My Three Keys is protected by all applicable intellectual property laws.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Breadcrumbs LLC, its members, officers, employees, assigns, and infrastructure service providers shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including without limitation, bodily injury, death, emotional distress, property damage, loss of profits, data, use, goodwill, or any other tangible or intangible losses, resulting from your access to or use of (or inability to access or use) the App; any failure of wireless networks, SMS transmission delays, GPS inaccuracies, the failure of any emergency/trusted contact to act upon receipt of a My Three Keys notification, and/or unauthorized access to or alteration of your transmissions or data.
7. Termination
My Three Keys reserves the right to terminate or suspend your account and access to the App immediately, without prior notice or liability, if you breach these Terms or engage in conduct that harms other users or the My Three Keys' business.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, United States, without regard to any conflict of law or principles. You agree that any legal action or proceeding arising out of or related to these Terms or the use of the App shall be brought exclusively in the appropriate state or federal courts located in Wayne Courty, Michigan or the Eastern District of Michigan. You irrevocably submit to the exclusive jurisdiction of such courts in any such suit, action, or proceeding.
9. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of changes by updating the “Last Updated” date at the top of this page. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
10. SMS Text Messaging Disclosures
By utilizing the safety notification features within the My Three Keys application, primary account users may initiate security notifications or invitations to designated contacts. For emergency tracking and safety alerts to be active, the recipient must explicitly consent by replying “YES” to an automated text invitation from their mobile handset.
